Claire McDaid recently negotiated an out of court settlement for GK in respect of treatment provided to her by neurology services in a local healthcare trust.
In 2014 GK was diagnosed with migraine headaches and over the course of the next 4 years was prescribed a variety of different mediations which caused serious adverse effects and did not improve her symptoms.
GK attended with an alternate neurologist in June 2018 who reviewed her diagnosis and medication which resulted in a positive improvement in her headache symptoms and general health.
We received instructions from GK in late 2021 and on receipt of her notes and records secured liability evidence from a Consultant Neurologist who concluded that the treatment provided to GK in respect of her headaches was inadequate and constituted a breach of duty. Pre-action correspondence was sent and in the absence of a response, High Court proceedings were issued with the assistance of legal aid funding.
We secured further reports from a Consultant Psychiatrist as well as a report from a headache specialist who detailed the extent of adverse effects suffered by GK by reason of the medication she had been prescribed.
In early 2024 the Defendant invited us to engage in without prejudice discussions and following discussions between the legal representatives, damages were agreed to reflect the level of pain and injury suffered by GK between 2014 and 2018.
